Proposal to levy separate rates to secure infrastructure contributions from developers

 

Council is considering the application of Separate Rates across various properties within the Residential (Gawler East) and Residential Hills Zones of Council’s current development plan.

The proposed Separate Rates are intended to act as a secondary financial security mechanism towards securing developer contributions of $25m as part of $80.1m of future identified infrastructure to be provided within the Gawler East development area. The identified infrastructure includes $54.4m for the construction of the Gawler East Link Road.

The proposed Separate Rates are intended on the basis that the infrastructure to be provided is intended to be of particular benefit to both the owners and occupiers within the Gawler East development area.

The primary source of securing the required developer contributions is intended to be via per new allotment contributions payable under an Infrastructure Deed arrangement with property developers.

The proposal provides for the automatic postponement of the Separate Rates as they are applied, with the amount of the ‘one-off’ Separate Rate only then becoming payable as development occurs. If the amount of the Separate Rate is paid under the Infrastructure Deed with the developer the Separate Rate will be remitted in full. If no development occurs, then no Separate Rate will be payable. Any funds generated by the proposed Separate Rates will only be applied towards the provision of the identified infrastructure within the Gawler East development area, in accordance with Section 154(10) of the Local Government Act 1999.

Directly affected landowners / developers have been advised of the consultation by letter.
