1999
Section90(2) of the Local GovernmentAct 1999 states:
90—Meetings to be held in public except in special
circumstances
(2)Acouncil or council committeemay order that the
public be excluded from attendanceat ameeting to the
extent (and only to the extent) that the council or council
committee considers it to be necessary and appropriate
toact inameeting closed to the public in order to receive,
discuss or consider in confidence any informationormatter
listed in subsection (3) (after taking into account any
relevant consideration under that subsection).
Section91(7) of the Local GovernmentAct 1999 states:
91—Minutes and release of documents
(7) However, subsections (4), (5) and (6) do not apply to a
document or part of a document if—
(a) thedocument or part relates to amatter dealt with by
the council or council committee on a confidential basis
under Part 3;
(b) and the council or council committee orders that the
document or part be kept confidential.
Local Government (General) Regulations 1999 states:
22A—Schedule 4—Annual reports
(1) For the purposes of clause1(ga) of Schedule 4 of the
Act—
(a) in the caseof a report on theuseof section90(2) of the
Act, the following information is required:
(i) the total number of ordersmade under that subsection
in the financial year;
(ii) in relation toeachparagraph ((a) to (n)) of section90(3)
of theAct— thenumber of times in the financial year
that an ordermade under section 90(2) wasmade on
thebasis that the information ormatter fell within the
ambit of theparagraph; and
(b) in the caseof a report on theuseof section91(7) of the
Act, the following information is required:
(i) the total number of ordersmade under that subsection
in the financial year;
(ii) thenumber of ordersmadeunder that subsection
that expired, ceased to apply or were revoked during
the financial year;
(iii) the number of ordersmade under that subsection that
remained operative at the end of the financial year (but not
includingordersmade before the commencement of this
paragraph.
This report includes the following information, identified for
bothCouncil andCommittees:-
• Number of occasions each of the provisions of Section
90(3) were utilised
• An indication of any particular issues that contributed
to the useof confidentiality provisions onmore than
one occasion
• Number of occasions that information originally
declared confidential has subsequently beenmade
publicly available
• Number of occasions that information declared
confidential has still not subsequently beenmade
publicly availableand the reason for this in each case.
During 2013/14Council reviewed its policies and
procedures as it relates to confidentiality provisions and
practice. Staff undertook an audit of the number of reports
andminutes kept in confidence.
